Please read these Terms of Service ("Terms") carefully before using xGenerator ("Platform", "we", "us", or "our"). By accessing or using xGenerator, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

1. Acceptance of Terms

By creating an account or using any part of xGenerator, you confirm that you are at least 13 years old (or 16 in the EU), have the legal capacity to enter into this agreement, and accept these Terms in full. If you are using the Platform on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

xGenerator is an AI-powered content platform offering 30+ tools across categories including text generation, image creation, summarization, and personal productivity. Features may include free and paid tiers, and we reserve the right to modify, limit, or discontinue any feature at any time.

3. Account Registration

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the confidentiality of your login credentials.
  • You are responsible for all activity that occurs under your account.
  • You must notify us immediately of any unauthorized use of your account.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

4. Permitted Use

You may use xGenerator for lawful personal, educational, or commercial purposes, subject to these Terms. You agree to use the Platform in a manner consistent with all applicable local, national, and international laws and regulations.

5. Prohibited Use

You must not use xGenerator to:

  • Generate content that is illegal, defamatory, obscene, hateful, or threatening.
  • Create or distribute misinformation, fake news, or deceptive content.
  • Infringe any third-party intellectual property, privacy, or other rights.
  • Spam, phish, or conduct any form of unsolicited communication.
  • Attempt to reverse-engineer, scrape, or harvest data from the Platform.
  • Circumvent any security, rate-limiting, or access-control mechanisms.
  • Use the Platform to train competing AI models without explicit written consent.
  • Impersonate any person or entity.

6. AI-Generated Content

xGenerator uses third-party AI models to generate content. You acknowledge that:

  • AI-generated content may be inaccurate, incomplete, biased, or inappropriate.
  • You are solely responsible for reviewing and verifying any AI output before use.
  • We make no guarantees regarding the accuracy, quality, or suitability of generated content for any purpose.
  • You must not present AI-generated content as your own original work in contexts where that would be dishonest or violate academic, professional, or legal standards.

7. Intellectual Property

7.1 Platform Content

All software, designs, logos, trademarks, and content comprising the Platform are the exclusive property of xGenerator or its licensors and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent.

7.2 Your Content

You retain ownership of the inputs you submit and outputs generated for you. By using the Platform, you grant us a limited, non-exclusive license to process your inputs solely for the purpose of providing the service. We do not claim ownership of your generated content.

8. Privacy

Your use of xGenerator is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, XGENERATOR AND ITS AFFILIATES, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM:

  • Your use of or inability to use the Platform.
  • Any content generated through the Platform.
  • Unauthorized access to or alteration of your data.
  • Any other matter related to the Platform.

11. Indemnification

You agree to indemnify, defend, and hold harmless xGenerator and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Platform, your violation of these Terms, or your infringement of any third-party rights.

12. Termination

We reserve the right to suspend or terminate your access to the Platform at any time, with or without notice, for violation of these Terms or for any other reason. You may terminate your account at any time by contacting us. Upon termination, your right to use the Platform ceases immediately.

13. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising from these Terms or your use of the Platform shall first be subject to good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration or the courts of the relevant jurisdiction.

14. Changes to Terms

We may update these Terms at any time. We will notify you of significant changes by updating the "Last Updated" date. Your continued use of the Platform after changes are posted constitutes acceptance of the revised Terms.
